Agreeing to these terms
KIZGO (“we”, “us”) operates kizgo.app. By using the site, and again when you create an account, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, please do not use KIZGO.
Who can use KIZGO
KIZGO is for parents and guardians planning outings: to use it, and especially to create an account, you must be 18 or older. Accounts are created by signing in with Google or Apple; keep your provider account secure, because whoever controls it controls your KIZGO account.
Your content
Reviews, edits, photos, and place suggestions you submit are yours — you keep ownership of what you post. So that we can run the service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, reproduce, and adapt (for formatting) your content in connection with operating and promoting KIZGO. Nothing in these terms limits your right to post honest reviews of any business, here or anywhere else.
By submitting content you confirm that:
- it reflects your genuine, first-hand experience;
- you have the rights to what you submit; and
- you were not paid or given anything in exchange for the opinion it expresses (if you received anything, say so in the content).
House rules
You agree not to:
- post fake, misleading, or paid-for reviews;
- post content that is unlawful, defamatory, harassing, or that violates someone else’s rights (including privacy — no photos of other people’s children without permission);
- impersonate others or misrepresent an affiliation;
- scrape, overload, probe, or otherwise interfere with the service; or
- use KIZGO for advertising or spam.
Moderation
Contributions are reviewed before or after publication. We may remove, decline, or edit-for-formatting any content, and suspend or terminate accounts, at our discretion — we apply neutral, content-based criteria (spam, policy violations, off-topic) and never remove reviews just for being negative.
About the place information
Place details come from public sources, venue operators, and parents like you, and they change faster than any index can. Everything on KIZGO — including age recommendations — is informational opinion and community input, not a safety guarantee. Hours, prices, and facilities may be wrong or out of date. Always verify before you go, and use your own judgment: you remain responsible for your family’s supervision and safety at any venue.
Copyright complaints (DMCA)
If you believe content on KIZGO infringes your copyright, send a takedown notice to support@kizgo.app with: your contact details, the work you believe is infringed, the URL of the material, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your physical or electronic signature. We remove infringing material expeditiously, accept counter-notices with the corresponding statutory contents, and terminate repeat infringers’ accounts.
Disclaimers
KIZGO is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that place information is accurate or complete.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for anything that happens at a venue you found through KIZGO. Our total liability for any claim relating to the service is limited to the greater of $100 or the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You will indemnify and hold us harmless from claims arising out of your content or your misuse of the service.
Ending your account
You can delete your account at any time from your account page. We may suspend or terminate accounts that violate these terms. Sections that by their nature should survive (content license for content you left up, disclaimers, liability limits) survive termination.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Small-claims court remains available to both of us for qualifying disputes.
Changes
If we change these terms, we will update the date at the top and, for material changes, ask you to accept the new version the next time you use your account. Continued use after a change means the new terms apply.
